TERMS AND CONDITIONS

1 Interpretation
1.1 "We, us, our" means Good Day Mate Pty Ltd ABN 44133884938, registered 18/04/2011 with trading name Solar4Ever, registered 21/04/2011, and Business name Solar4Ever registered 01/06/2021.
"You, your" means the person whose name and address are shown on the quotation.
1.2 In these Terms headings will not affect the construction of these Terms.
1.3 The "System" is all the goods and services described in the quotation.

2 The Quotation and Contract
2.1 The quotation and these terms together govern our supply of goods & services to you (Terms).
2.2 You agree you have read and understood these Terms.
2.3 The Contract comes into force when you either accept the quotation by clicking on the 'Accept' button that is presented to you in the email you have received via the Xero accounting platform or sign the quotation, scan and email it to us at mailto:info@solar4ever.com.au
2.4 This Contract ends when we have finished the installation of the System.
2.5 Whilst accepting the quotation enters you into a legally binding Contract that we agree to sell, and you agree to purchase the System at the agreed price we also offer you the opportunity to cancel the Contract at any time prior to the installation of the System as described in clause 8.1.

3 Jurisdiction
3.1 The Contract and these Terms shall be governed by the laws of Western Australia and any disputes shall be referred to the Courts of that State.

4 Installation
4.1 The "System" described in the quotation will be installed by skilled and experienced SAA (formerly CEC) accredited electricians, namely Nathan Thomas and Jack Harris who may also be assisted in the installation by electrical apprentices.
4.2 Our installation will comply with all relevant Australian standards and laws and Western Power and Synergy regulations and requirements and all other relevant codes that are required to be followed when installing solar inverters and battery storage and photovoltaic (PV) modules and all associated equipment.
4.3 We shall provide you with an Electrical Safety Certificate and any other required documents as required by law on completion of the installation.
4.4 You give your permission to our installers to be at the installation address for the entire duration of the installation and for any site inspections that may be required prior to installation of the System.
4.5 You agree to be personally present or have an authorised person of your choice present for at least the first hour of the installation of the System to ensure panel, inverter, battery and other associated equipment is positioned in an agreed manner.
4.6 You understand that any drawings, roof mappings and designs, power production estimates that we may have provided you during the quotation and sale process are subject to change if the SAA accredited installer deems a change to be necessary but that any such changes will be discussed with you before work commences. If you do not agree to the changes and we are unable to find a compromise and proceed with the installation then this Contract will be cancelled at no cost from us to yourself.

5 Australian Consumer Law, NETCC and Privacy
5.1 We will abide by all rules relating to the sale and the installation of the goods and all services as required under Australian Consumer Law.
5.2 We are not covered by the Privacy Act 1988 but we will nonetheless ensure that we do not disclose any personal information about you, your family or any details about the installation address to others without your prior permission given to us by you in writing.
5.3 We are bound by the New Energy Tech Consumer Code (NETCC).

6 Approvals, Synergy and Western Power and others
6.1 We will promptly apply on your behalf for approval from Synergy and Western Power to install the System at the installation address and connect to the electricity grid and keep you updated on the progress of the applications and that you understand that Synergy may change your electricity tariffs as a result of this application and our subsequent installation of the System.
6.2 If you prefer to apply to Synergy and Western Power yourself, we shall assist you in your application if you request our help.
6.3 The sale and installation of the System are dependent on obtaining approval from Synergy and Western Power and that in the event that their approvals are not successfully obtained then this Contract is cancelled.
6.4 You are responsible to pay all fees and charges payable to Synergy or Western Power for any goods and services they provide, which may include but not be limited to, a new bi-directional electricity meter.
6.5 You understand that if the total capacity of the new solar inverters described in the quotation and any others that are already active at the installation address is 5kW or less then Synergy will have the ability to shut down entirely, or reduce the electrical output, of the inverter or inverters at any time under the terms of their agreement with you for Emergency Solar Management (ESM) events or testing. You further understand that you are required by Synergy to maintain an active internet connection for the solar inverter in order that Synergy can control the inverter.
6.6 You understand that if the total capacity of the new solar inverters described in the quotation and any others that are already active at the installation address is greater than 5kW then the inverters in their totality will be limited to no more than 1.5kW of total export across all phases.
6.7 You understand that you may be eligible for payments or credits from Synergy for electricity recorded by the electricity meter as export, commonly referred to as a Feed-In-Tariff, if the total inverter capacity at the installation address is 5kW or less but that if the total inverter capacity at the installation address is greater than 5kW then no payment for any export will be paid.
6.8 If you are required to seek other approvals prior to us installing the System, then it is your responsibility to do so, and ensure approval is granted prior to the installation commencing and that you keep us informed as to the progress of your application. Such other approvals might be, for example if the installation address is under a strata title or within a retirement village.

7 Deposits and Payments
7.1 We do not require you to pay any deposits to us.
7.2 We require that payment in full for all the goods and services described in the quotation is made within three days of the completion of the installation at the installation address.
7.3 Title in the goods and services described as the System passes to you when we have received your full payment cleared into our Commonwealth bank account.
7.4 Payments made by you for the System in part or in full by Mastercard or Visa incur a 1.5% surcharge to cover the fees charged by the Commonwealth Bank of Australia, BPoint Merchant service that we use to process payment by credit or debit cards. We do not accept payment from any other type of credit card.

8 Cancellation
8.1 Under Australian Consumer Law you have 10 business days to cancel this Contract (Cooling Off Period).
8.2 You may cancel this Contract for any reason without penalty at any time prior to the installation commencing.
Some examples where you might wish to cancel would be where;
(a) additional chargeable work not within the contract price is identified and you are not willing to bear those additional costs,
(b) the design of the System changes significantly from that previously provided to you whether provided in our quotation or as a first deliverable under this contract, and you are not willing to accept the change,
(c) if we provide you with a site-specific installation design or plan and site-specific performance estimate as an initial deliverable under the contract (rather than as part of our quote) and within 10 business days of receiving our site-specific installation design plan and performance estimate, you notify us that you do not accept these,
(d) if we fail to meet the timeframe specified in this Contract for delivery and installation (if applicable), or commencement of service of the goods described in the quotation.
8.3 We may cancel this Contract without penalty at any time prior to the installation commencing for any reason and may also cancel this Contract if we discover on inspecting the installation address that it is an unsafe environment for our installers.
8.4 If the Contract is cancelled by either party, you will remain liable for any fees and charges for goods and services provided by other parties including but not limited to Synergy and Western Power.

9. Damage to your roof and premises
9.1 If your roof is tiled then we require you to have available to the installers, a minimum of 6 spare roof tiles.
Spare, used roof tiles can usually be purchased from Belmont Salvage in Kenwick for $5 each.
9.2 We will take great care not to damage the roof or any other part of the premises during the installation of the System but in the event that any damage occurs as a result of our negligence then we shall take full responsibility to ensure that the damage is repaired at our expense as quickly as possible.
9.3 We shall not be responsible for any damage that occurs which is not directly due to our negligence, including but not limited to the roof's ability to support the weight of the solar panels.

10 Complaints
10.1 If you wish to make a complaint about any aspect of your interaction with us at any time before, during or after installation of the System then we encourage you to do so by either calling us on (08) 9467 9655 or by emailing to mailto:info@solar4ever.com.au
10.2 We will acknowledge our receipt of your complaint as soon as possible.
10.3 We will provide an initial response to your complaint within a maximum of 15 business days from receipt of your complaint, and that we will provide a final response within a maximum of 25 business days.
10.4 If you are not satisfied with our handling of your complaint then you can escalate your complaint to external dispute resolution bodies including;

11 Warranties and guarantees
11.1 We guarantee the workmanship carried out by us after installing the System for a period of 5 years from the date the installation has been completed and that we will, at no cost to you, promptly repair or replace any faulty goods during that 5-year period if you have notified us of any defect.
11.2 This guarantee is in addition to any warranties and guarantees provided by the manufacturers of the goods described in this quotation and referred to as the System. We shall act on your behalf with these manufacturers if you wish or else provide you with any assistance that we can reasonably provide to assist you in your own dealings with the manufacturers if you prefer.
11.3 This guarantee is in addition to any warranties and guarantees that are applicable under Australian Consumer Law or any other Australian or West Australian law.

12. Small Scale Technology Certificates (STCs)
12.1 You authorise us to apply for any STC incentive to which you may be entitled in connection with the supply or installation of the goods and services under the Contract. Under this Contract you assign the rights under any STC incentive to us. If such incentive is withdrawn, reduced significantly or otherwise unavailable to you we may (a) vary the price in the Contract by an amount equivalent to the incentive that is not received; or (b) terminate the Contract without any further liability to you and you must pay for goods and services provided to you up to that date. If the STC incentive is not received by us for any reason, we may charge you an amount equal to the incentive not received.
12.2 You will receive an email within a few hours after the installation of the System from our STC aggregator, Green Deal requesting you to approve that the installation has been completed and a request for you to sign their STC assignment documentation and you agree to do so within 72 hours of the email being sent to you by Green Deal.
12.3 We have calculated any STCs that are eligible to be earned by you after the completion of the installation of the goods at the installation address as shown as an up-front discount of the total price you pay on the quotation.
12.4 The value of the up-front discount provided was calculated by multiplying the quantity of STCs by the approximate current value paid for each STC by the STC aggregator Green Deal.
12.5 The calculation of the quantity of STCs that are eligible with the installation was carried out using the online calculator provided by the REC Registry using the installation address postcode, the rated power output in kW of the system and for the maximum number of years allowed for the date of the installation.

13 GST
13.1 GST is calculated on the full price of the System in the quotation before the deduction of the value of the STCs which are themselves usually exempt from GST unless you are purchasing the System as a GST registered entity.
